91.213(d) Flow

With no approved MEL, an inoperative item may be flown only if it is not required by the type certificate, the VFR-day equipment list, an airworthiness directive, or the operating rules — and it is then removed or deactivated and placarded “Inoperative”, with a determination that the aircraft remains safe for flight.
